VisionPro Shop, LLC has a 7 day inspection and return policy. If items provided by VisionPro Shop, LLC are not acceptable to the buyer the buyer must return the items within 7 days. of delivery to the buyer in their original undamaged condition. There are no exceptions to this policy unless expressly authorized by VisionPro Shop, LLC.
Express Warranty, Limitation and Exclusion and Disclaimer of Unstated Warranties Warranty.
The warranty period is one year (365) days and commences on the date of shipment. Seller's warranty obligation is limited to providing remedial service during Seller's normal business hours and days during the warranty period and repairing or replacing at its option. Equipment which has been, during the warranty period, promptly reported by Purchaser as defective in material or workmanship and is so found by Seller upon examination, will be repaired or replaced at Seller's option. Examination and repair or replacement of such Equipment will be effected on location or at Seller's facilities, at Seller's option, with no charge to Purchaser for service time expended. Equipment to be examined, replaced or repaired at Seller's facilities must be returned to Seller by Purchaser within the warranty period, transportation charges prepaid. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
Warranty Limitation and Exclusion.
Seller will have no further warranty obligation under this Agreement if the Equipment is subjected to any unauthorized adjustment or disassembly, abuse, misuse, negligence, or accident; or if the Equipment is used with any unauthorized accessories or fittings not expressly sanctioned by and or manufactured by VisionPro Shop, LLC.
Disclaimer of Unstated Warranties.
THE WARRANTY PRINTED ABOVE IS THE ONLY WARRANTY APPLICABLE TO THIS PURCHASE. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED.
Limitation of Liability.
IT IS UNDERSTOOD AND AGREED THAT SELLER'S LIABILITY WHETHER IN CONTRACT, IN TORT, UNDER ANY WARRANTY, IN NEGLIGENCE OR OTHERWISE SHALL NOT EXCEED THE RETURN OF THE AMOUNT
OF THE PURCHASE PRICE PAID BY PURCHASER AND UNDER NO CIRCUMSTANCES SHALL SELLER BE LIABLE FOR SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES. THE PRICE STATED FOR THE EQUIPMENT IS A CONSIDERATION IN
LIMITING SELLER'S LIABILITY. NO ACTION, REGARDLESS OF FORM, ARISING OUT OF THE TRANSACTIONS UNDER THIS AGREEMENT MAY BE BROUGHT BY PURCHASER MORE THAN ONE YEAR AFTER THE CAUSE OF ACTION HAS ACCRUED. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
